Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DataSec bot detection and mitigation platform operated by Aqua Networks Limited, a company incorporated in England and Wales (Companies House number 07207169), registered office at 20-22 Wenlock Road, London, England, N1 7GU, United Kingdom ("DataSec", "we", "us"). By using the Service, you agree to these Terms.
1. The Service
DataSec provides a bot detection and mitigation platform that analyzes web, API, and mobile traffic to distinguish human users from automated bots, and applies configurable response actions (allow, challenge, rate-limit, block) based on risk scores. The specific features available to you depend on your subscription plan.
2. Your Account
You are responsible for maintaining the confidentiality of your API keys and account credentials. You must notify us immediately of any unauthorized access. You may not share account credentials across organizations.
3. Acceptable Use
You may not use the Service to: violate any applicable laws; interfere with other users or systems; attempt to reverse-engineer DataSec's detection logic; or resell or sublicense the Service without written permission.
4. Data Processing
When you deploy the Service on your platform, we process end-user traffic data on your behalf as a data processor. A Data Processing Agreement (DPA) is available on request and is incorporated into these Terms for customers subject to GDPR/UK GDPR requirements.
5. Payment
Subscription fees are charged in advance per billing cycle. Overages (requests above your plan limit) are charged at the end of each billing cycle per your plan's overage rate. All fees are non-refundable except as required by law or as explicitly stated in your order form.
6. Intellectual Property
DataSec retains all rights to the Service, including its detection models, algorithms, and infrastructure. You retain all rights to your data.
7. Warranties and Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, DataSec's liability is limited to the fees you paid in the 12 months preceding the claim. DataSec is not liable for any indirect, incidental, or consequential damages.
8. Indemnification
You agree to indemnify DataSec against claims arising from your use of the Service in violation of these Terms or applicable law.
9. Term and Termination
Either party may terminate for the other's uncured material breach. Upon termination, your right to use the Service ends, subject to any data export or retention obligations set out in your order form or DPA.
10. Governing Law
These Terms are governed by the laws of England and Wales. Disputes will be resolved exclusively in the courts of England and Wales, unless a separate enterprise agreement specifies otherwise.
11. Changes
We may update these Terms; material changes will be notified via the website or email with reasonable advance notice.
